The Court will be creating an Estate Only – Petition for Probate calendar on 2 special days in June and July, to see if we can reduce the waiting time for the calendar. This special calendar will only cover Petition for Probate (DE-111), Spousal Property Petition (DE-221), and Petition to Determine Succession (DE-310). If someone wants to file a Petition for Final Distribution or anything concerning post-appointment issues, then those matters will go on the regular Department 13 calendar. The purpose of the extra calendar is to get to cases sooner when an appointment of the personal representative is required.

There are a total of 15 slots open each calendar.

Cases already scheduled for a later hearing can switch to these dates, if they are willing to do a new notice for the hearings. (If cases do get set earlier, then some slots would become available for people filing the post-appointment petitions.)

Probate cases generally fall into three categories:

Probate of wills, trusts and estates:
Probate is the court-supervised process by which your assets are distributed and debts are paid after your death.

A judge will appoint a conservator when they determine through a court process that a person cannot take care of themselves or their finances.

The judge gives someone that is not the child's parent custody of the child or the right to control the child's property or both.

Fees are required to be paid in conjunction with any of the above listed filings. You may ask the court to waive the filing fee if your household income falls below certain guidelines.
